Terms of Service

HumanLevelUP is operated by IGEARS TECHNOLOGY LIMITED. In these Terms of Service, "HumanLevelUP", "we", "us", and "our" refer to the HumanLevelUP product and the company that operates it, IGEARS TECHNOLOGY LIMITED.

1. Acceptance of these Terms

By accessing or using HumanLevelUP at humanlevelup.org, creating an account, purchasing a subscription or credit pack, or running workflows through the platform, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Description of the service

HumanLevelUP is a workflow automation platform that lets you build, run, and manage AI-assisted and rules-based workflows. Depending on how you configure it, the service may process prompts, documents, emails, metadata, logs, workflow steps, approvals, and actions through third-party AI providers and external connectors such as email, webhooks, calendars, or other connected services.

The service may change over time. Features may be added, modified, limited, or removed, especially during beta or early production stages.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use HumanLevelUP. If you use the service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Accounts and your responsibilities

You are responsible for your account, your credentials, your connected tools, and all activity that happens under your account. You must provide accurate information, keep your login details secure, and notify us promptly if you believe your account has been accessed without authorization.

You are also responsible for reviewing your workflow configuration, approval settings, destination systems, recipients, prompts, and action logic before enabling automation.

5. Acceptable use

You may not use HumanLevelUP for illegal, abusive, infringing, deceptive, or harmful automation. This includes using the service to:

  • violate law, regulation, court order, or another person's rights;
  • store, generate, or distribute unlawful, fraudulent, harassing, defamatory, hateful, or abusive content;
  • infringe intellectual property, privacy, confidentiality, or data protection rights;
  • send spam, malware, phishing, or unauthorized bulk communications;
  • attempt unauthorized access to systems, accounts, networks, or data;
  • interfere with the security, integrity, or availability of the platform;
  • circumvent limits, billing controls, or technical restrictions; or
  • build or run workflows that could cause foreseeable harm without appropriate human review or safeguards.

6. Third-party AI providers and connectors

HumanLevelUP depends in part on third-party services. Prompts, workflow data, action payloads, and other content may be processed by AI providers and connectors that you choose or enable in order to perform the workflow you requested.

We do not control third-party providers or connectors, and we are not responsible for their availability, output quality, security practices, pricing, policy changes, or acts or omissions. Your use of those third-party services may also be governed by their own terms and privacy policies, and you are responsible for using them lawfully and appropriately.

7. Billing, credits, subscriptions, and pricing changes

Certain features may require paid plans, purchased credits, usage-based charges, or other fees. If you subscribe to a paid plan, you authorize us and our payment processor to charge the applicable fees and taxes using your selected payment method.

AI credits may be consumed when AI-powered steps or other paid features are used. Workflow runs and AI credits are tracked separately, and credit usage estimates are informational only. Actual usage may vary based on task size, workflow configuration, provider or model choice, and the number of AI steps involved. Unless required by law, credits are generally non-refundable, including for unused balances, partial billing periods, failed experiments, or workflows you configured incorrectly.

We may update pricing, plans, features, or credit policies from time to time. If we make a material pricing change to a recurring paid plan, we will provide reasonable notice before it takes effect.

8. Intellectual property

HumanLevelUP, including the platform, software, design, branding, interfaces, and related content, is owned by or licensed to IGEARS TECHNOLOGY LIMITED and is protected by applicable intellectual property laws. These Terms do not transfer ownership of our intellectual property to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the service for your internal business or personal use.

9. Your content and license to operate the service

You retain ownership of the prompts, files, workflow definitions, instructions, records, and other content you submit to HumanLevelUP ("User Content").

You grant us a limited, non-exclusive, worldwide license to host, store, copy, transmit, transform, and process User Content only as needed to operate, secure, maintain, and improve the service for you, including sending data to configured AI providers, connector endpoints, subprocessors, and logs required to complete the workflow you requested.

You represent that you have all necessary rights and permissions to submit User Content and to instruct us to process it through the service.

10. AI outputs and workflow actions

AI-generated outputs may be incomplete, inaccurate, biased, delayed, misleading, or unsuitable for your use case. Automated workflow actions may also send, modify, or create records based on incorrect assumptions or configuration mistakes.

You are responsible for reviewing outputs and workflow behavior before relying on them, especially for legal, financial, employment, customer-facing, compliance, safety-sensitive, or other high-impact decisions. Human review remains your responsibility unless you intentionally choose to automate without it.

11. Disclaimer of warranties

HumanLevelUP is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, IGEARS TECHNOLOGY LIMITED disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the service will be uninterrupted, error-free, secure, or compatible with every workflow, provider, connector, browser, or device.

12. Limitation of liability

To the maximum extent permitted by law, IGEARS TECHNOLOGY LIMITED and its directors, officers, employees, affiliates, contractors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or opportunity arising out of or related to your use of HumanLevelUP.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to the service will not exceed the amount you paid to us for HumanLevelUP in the 12 months before the event giving rise to the claim, or USD $100 if you have not paid us anything.

13. Indemnity

You agree to defend, indemnify, and hold harmless IGEARS TECHNOLOGY LIMITED and its affiliates, personnel, and service providers from claims, liabilities, damages, losses, and expenses arising out of or related to your User Content, your workflows, your use of the service, your connected systems, or your violation of these Terms or applicable law.

14. Suspension and termination

We may suspend, restrict, or terminate access to HumanLevelUP if we reasonably believe you have violated these Terms, created security or legal risk, failed to pay fees when due, or used the service in a way that could harm us, other users, or third parties.

You may stop using the service at any time. Certain sections of these Terms will continue to apply after termination, including sections relating to payments owed, intellectual property, disclaimers, limitations of liability, indemnity, and dispute resolution.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify you by email, inside the product, or by posting an updated version on this page. Your continued use of HumanLevelUP after the updated Terms take effect means you accept them.

16. Governing law and jurisdiction

These Terms are governed by the laws of Hong Kong, without regard to conflict of laws principles. The courts of Hong Kong will have exclusive jurisdiction over disputes arising out of or relating to these Terms or your use of HumanLevelUP, except where applicable law requires otherwise.
